 CHRISTIAN FAMILY IN AHMEDABAD GETS JUSTICE
 

The honourable High Court of Gujarat has passed an order to shut down a manufacturing unit that cause untold nuisance to a Christian family in the neighbourhood.

Mrs. Mrudula John Christie residing at Maninagar in Ahmedabad, Gujarat had filed a Special Civil Application NO. 2284/2009 before the Hon'ble Gujarat High Court alleging mental torture. The Hon'ble Gujarat High Court has given justice to Mrs. Christie who is a peace loving government employee from minority Christian community.

Mrs. Mrudula John Christie is residing along with her husband Mr. John Christie and their two sons at 12, Shalom Park (Ambenagar) Society, Maninagar, Ahmedabad, Gujarat, India for a long time and the said couple are government employees whereas their two major sons are taking higher education in the science stream.

Mr. Dharmenra Parsottambhai Patel and Mr. Dilip Navalkishor Dixit were running the factory for making jeans in the House No. 10 and 11 respectively located near the house of Mrs. Mrudula John Christie. Due to the heavy and noise making machines, the said Christians had to suffer a great nuisance. Also, damage occurred to the house and the furniture and therefore Mr. and Mrs. John Christie had requested Mr. Dharmendra Patel and Mr. Dilip Dixit to reduce the noise. But the men caused their factory to make more noise and therefore the said government employee Christian couple suffered mental torture and they could not do the work silently at the place of their duty. Their sons had also to go to the house of their friends to study. Mr. Dharmendra Patel, proprietor of the nearby factory had threatened, "I will do the work in this way only; you can do whatever you wish".

Therefore Mr. & Mrs. John Christie filed written police complaint under sections 153, 504, 506(2), 294(B), and 114 of Indian Penal Code before the Amaraiwadi Police Station and had lodged the complaint under sections 294 (B), 506(2), and 114 in such three sections only of Indian Penal Code on 14/03/2009.

Mr. Dharmendra Patel lodged a false police complaint against Mr. John Christie and their two sons on 25-03-2009.

Therefore Mr. and Mrs. John Christie requested the legal help of the All India Christian Council for relief from the torture. Under the guidance of All India Christian Council, Gujarat State unit, a Special Civil Application No. 2284/2009 was lodged before the Hon'ble Gujarat High Court (1) for doing profitable business by running the machines in the residential area, (2) for spreading the noise pollution by doing noise, (3) for giving mental torture to the Christian family by lodging false complaint, (4) for doing the misuse of the electricity given at the reasonable rate by running the factory in residential area.

The case was filed along with the evidence, in which the Hon'ble Chief Justice Mr. S.J. Mukhopadhyay of Gujarat High Court, Hon'ble Justice Mr. Anant S. Dave of Division Bench, took a decision. The pollution control Board was ordered to do necessary proceedings and the orders made to wind up the said jeans factory till the next hearing is scheduled on 25-02-2010.

The All India Christian Council appreciates this justifiable attitude of the Hon'ble Gujarat High Court and does hereby pray along with assurance that the exploited society will get the justice in future.
