Delhi (PTI): The Congress on Monday said it was
unfortunate that all accused in the H.S. Sabharwal
murder case were acquitted by a Nagpur court and
questioned the role of BJP-ruled Madhya Pradesh
government in the acquittal.
"This is unfortunate. We do not comment on court outcome
but from day one, the state machinery was hand in glove
with the accused. The blinkered, one-sided view of the
Madhya Pradesh government has led to this..." party
spokesman Abhishek Manu Singhvi told reporters here.
Reacting to the acquittal of the six accused, he said,
"We are deeply pained. His (Sabharwal) son had made
credible allegations against the state government. This
has come true."
Mr. Singhvi said judgement "depends on the quality of
prosecution and investigation" and blamed "inefficient
investigation and prosecution" for the acquittal. "What
can one expect from a callous and lackadaisical state
government?" he asked.
He said if the state government does not appeal against
the order of acquittal, Sabbharwal's family can go for
an appeal.
"This is no ordinary crime. Students murdered a teacher
in front of a camera. But still if a court ruling like
this comes, it is prosecutorial collusion," Mr. Singhvi
said.
He said there had been cases where the court is
convinced about the guilt of accused but had to acquit
them for want of evidence which must be brought in by
the prosecuting agencies.
Sabharwal, Head of Political Science Department of
Madhav College, Ujjain, died in August 2006, when he was
allegedly beaten up by ABVP activists over student union
elections.
