Hueiyen News: The Government of Manipur has
framed the Manipur Policy for Review of Unauthorized
Construction of Religious Nature and set up a committee
to review unauthorized construction of religious nature
on public streets, public parks and public places, etc.
State Chief Secretary is the chairman of the committee,
which would review unauthorized constructions of
religious nature like temple, church, mosque, gurudwara,
etc., which had already taken place prior to September
29, 2009 on public street, Public Park or any other
public places etc., and secretary, revenue, home, tribal
development, MAHUD, Arts and Culture, law, deputy
commissioners of districts are the members.
The committee has been constituted for implementation of
a directive of the Supreme Court of India passed on
September 29 with regard to the restriction to the fresh
unauthorized constructions of Temple, Church, Mosque or
Gurudwara etc., on public streets, public parks or other
public places.
The order of the Supreme Court covers all states and
union territories of the country.
The highest court of the country also asked all states
and union territories to formulate a policy regarding
the removal/reallocation/regularization of unauthorized
construction and to comply with the order and frame the
policy within a period of time.
In pursuance of the direction of the Supreme Court of
India, Manipur government made the policy.
Under the policy which would come into force with
immediate effect, all deputy commissioners/district
magistrates have been asked to comply with the direction
of the Supreme Court and instruct to ensure that no
fresh unauthorized construction has been carried out or
permitted in the name of Temple, Church, Mosque or
Guruduwara etc., in the scheduled places aforesaid.
They were also asked to furnish action taken report by
third day of every month to the secretary (Home) or to
an officer of the department assigned by the secretary
home for the purpose with regard to the matter.
The Deputy Commissioners are to furnish the information
with a list of such unauthorized construction of the
religious nature in their respective area of operations
with the class of land, the kind of construction, area
covered, exact location, years/months of
standing/existing, public importance (if any) and
comments and view on such structures.
The committee will have its own desecration to the
manner of procedure to examine each case of unauthorized
constructions of religious nature as provided by the
provision of the policy in removing of unauthorized
structures, relocation of the structure, regularization
of the structure by using appropriate order etc.
State home department will place the recommendation of
the committee before the Cabinet for decision and takes
up action as per the decision of the Cabinet.
